PA Legislature Considers Ill-Advised Change to Human Relations Act

 

The PA House of Representatives is considering an Amendment to the PA Human Relations Act which would add sexual orientation and gender identity as protected classes.  The AFA of PA reports: 

 

The PA Supreme Court upheld a decision throwing out an amendment to Pennsylvania's Hate Crimes Bill which had added sexual orientation and gender identity to the list of protected groups. (Ted Hoppe and Aaron Martin of the law Firm of Hoppe & Martin both worked on that case.)

The concerns about this legislation and the harm that it would bring are not just speculative. In 2004 Michael Marcavage and 10 others (the Philly 11) were arrested and charged with a hate crime under the former provisions of the Hate Crimes Bill. This charge could have resulted in jail time if they had been convicted. Their crime? – speaking on the public streets and sidewalks about the sin of homosexuality at a homosexual event.

The AFA makes reference to a report in the Philadelphia Inquirer about a transvestite who wanted to use an opposite gender changing facility at a Kmart. Additionally, in England, a country that has experienced the effects of hate crimes bills and including sexual orientation as a protected class, a preacher was arrested for speaking on a public street about sins referred to in the Bible including same sex relationships.
